1. Introduction
Provider Identity: The service is provided by Baunz Limited, with registered office at 7 Florinis Street, Greg Tower, 1065, Nicosia, Cyprus, registered with the Cyprus Companies Register under number HE471060.
These Terms and Conditions govern access to and use of the Baunz app and website by users who book or join games, teams, and sports fields through the platform. By continuing to use Baunz, you confirm that you have read, understood, and accepted these Terms.
2. Account Registration and Access
- A personal Baunz account is required to book fields or join games.
- Access is mandatory for anyone wishing to make an in-app payment or create a public match.
- Users are responsible for keeping their credentials confidential.
3. Bookings, Payments, and Service Fees
- Bookings and payments are managed directly by Baunz via Stripe Checkout using a Marketplace setup.
- A service fee is applied to each transaction, visible at the time of payment, and is non-refundable under any circumstances. Baunz reserves the right to change the fee amount at any time without needing to update these Terms and Conditions.
- Users can book fields or join games individually or through shared payments.
3.1. Hybrid Payment Mode
- Baunz offers a hybrid payment option that allows players to choose whether to pay:
- online by card, or
- in cash at the field.
- When this mode is selected:
- a temporary pre-authorization is placed on the credit card of the user who created the game or team (the "captain");
- this pre-authorization acts as a security measure to ensure payment.
- The pre-authorization:
- is automatically released once the cash payment is completed and confirmed at the field;
- may take up to five (5) business days to be released, depending on the bank or card issuer.
- In the case of:
- failure to pay in cash, or
- violation of the applicable cancellation policy, the full booking amount plus the non-refundable service fee will be charged to the pre-authorized card.
3.2. Captain’s Responsibility in Hybrid Payment Method
- When the hybrid payment method is selected, the system places a pre-authorization on the credit card of the user who created the booking or team, referred to as the "captain".
- The captain is solely financially responsible if:
- other players select "cash" and fail to pay at the field;
- one or more participants do not show up;
- there are violations of the cancellation policy (Section 4).
- In such cases, the missing amount will be fully charged to the captain’s card using the active pre-authorization. This ensures the booking payment is completed, even in case of default by other participants.
4. Cancellations, Refunds, and Right of Withdrawal
4.1. User-Initiated Cancellations
Users may cancel under the following terms:
- More than 24 hours before:
- full refund, excluding the non-refundable service fee.
- Between 24 and 6 hours before:
- 50% refund of the booking amount. The service fee is non-refundable.
- Less than 6 hours before:
- no refund. The full amount and the fee will be charged.
- No action is required on the user’s part to cancel — simply use the app.
4.2. Field-Initiated Cancellations
In rare cases, the field owner may cancel a booking (e.g., due to technical issues, weather conditions, or unexpected events). In such cases, you will receive a full refund, including the booking amount and service fee.
- Cancellations will be promptly communicated via the platform or email. Baunz is not responsible for indirect damages resulting from such cancellations (e.g., transportation costs, lost time, etc.).
Right of withdrawal: Under Article 59(o) of the Italian Consumer Code (Legislative Decree 206/2005), the right of withdrawal does not apply to leisure services tied to a specific date or time. By confirming your booking, you expressly waive your right of withdrawal.
5. Code of Conduct and Account Suspension
- Users must comply with the internal rules and regulations of the sports facilities they book.
- No-shows do not entitle users to refunds but do not restrict future use of the platform.
- In cases of abuse, fraud, attempted fraudulent payments, or other misconduct, Baunz reserves the right to suspend or close the account.
